Legal Rights
of Persons Injured By Vehicles With Safety Defects Including Seat Belt Injuries
And Failures
|
| Lawsuits have been filed by injured drivers and passengers
and the families of loved ones who have died in rollover crashes and other types
of accidents alleging that the SUVs, vans or other vehicles that they were driving
or riding were unacceptably likely to roll over in the event of a sudden maneuver
or accident and had other safety defects that the manufacturers were aware of,
such as faulty or poorly designed seat belts. |
| For example, in 2005 a Texas jury found that Ford
Motor Co. should pay $42 million to the family of a 10-year-old boy who was killed
when he was partly ejected from a Ford Expedition in a 2004 rollover accident. |
| In 2006, Ford Motor Co. lost an appeal of a $30-million
verdict by a Los Angeles County Superior Court jury that found the company sold
Windstar minivans with defective seat belts. Ford was sued by relatives of Johan
Karlsson, who was 5 years old in 1996 when the family's minivan hit a roll of
steel that fell from a truck on a highway, breaking the child's spine and leaving
him a paraplegic. |
| Damages sought against car and SUV manufacturers have
included punitive damages for allegedly manufacturing a vehicle with safety defects
and include general and compensatory damages for: |
- Wrongful death;
- Past and future physical pain and suffering, mental anguish and physical
impairment;
- Past and future medical, incidental and hospital expenses; and
- Past and future loss of earnings and earning capacity.
