Montero, Endeavor and Outlander Lawsuits: Mitsubishi
SUV Rollover Dangers |
|
| Around the nation, lawsuits have been filed against
Mitsubishi for defects in Montero, Montero Sport,
Endeavor and Outlander. |
| It has been alleged
in litigation against Mitsubishi that certain
models of their SUVs that may include the Montero,
Montero Sport, Endeavor and Outlander are
defective and unreasonably dangerous for the
following reasons: |
- The vehicle is defective in that it was
not designed to provide reasonable and necessary
occupant protection in the event of a rollover
accident;
- The vehicle is defective in that the design
of the track width , wheelbase and vertical
center-of-gravity height, creates an unreasonable
risk of rollover given the uses for which
the vehicles was marketed;

- The defects in the design of the track width,
wheelbase and vertical center-of-gravity height
create an unreasonable and extreme risk of rollover
that is both beyond the expectations of the consumer
and create a risk that far outweighs any benefit
associated with the design;
- The vehicle is defective in that the roof and
its supporting pillars fail to afford the occupants
sufficient protection during a rollover;

- The vehicle is defective in that the
seat belts fail to provide sufficient occupant
protection in the event of a rollover by
allowing inertial forces to unbuckle the
belt or release slack into the restraint
system; and
- Mitsubishi failed to adequately warn
or instruct consumers of the dangers associated
with incidents of rollover.

| It has been further alleged that Mitsubishi
was negligent in one or more of the following
ways: |
- Negligently designing the vehicle from
a handling and stability standpoint;
- Negligently designing a vehicle with
poor rollover resistance;
- Negligently designing a vehicle with
poor occupant protection in the event
of a rollover;
- Failing to test the vehicle to ensure
proper occupant protection in the
event of a rollover;
- Failing to disclose known problems
and defects to the general public; and
- Negligently concealing known
dangers associated with the roof
collapsing as a result of a rollover.
