The Ford Explorer rolled over in the road and continued into the median between the northbound and southbound I-25 lanes. The Explorer came to rest on its roof.
"During the incident, the Explorer's right rear seat belt system failed and the right rear passenger side glass shattered, leaving the passenger compartment open and unprotected," the complaint states.
The suit states that Ford and Capitol are liable because they "manufactured, marketed, placed on the market and sold a defective product, unreasonably dangerous to the consumer caused by an unreasonable risk of injury resulting from a condition of the product or from a manner of its use."
